Act of Banning fuels by DPCC

DPCC released a list of DPCC fuels permissible to be used by the industries on July 4th, 2018 within the NCT (National Capital Territory). This was supported by the Centre for Science and Environment (CSE).

DPCC gave 90 day time period for the industries. This was for those industries which are using the fuels which are not permissible to make the switch to the approved fuels. Any other fuel use is not permissible and thus not to be used in the NCT of Delhi.

“All other fuels will be deemed unapproved and so disallowed for use in NCT of Delhi,” the notification read.

Further comments have been made by Anumita Roychowdhury (the Executive director-research and advocacy, CSE) “Dust particles in the air get coated with toxic substances from combustion and can go deep into the lungs. Cleaner fuels for combustion are an important step forward to reduce the toxicity of emissions. Clean fuels not only improve the efficiency of emissions control systems but also reduce emissions of toxic compounds and lower the risk to human health. CSE has been advocating for this notification for some time now.”

List of DPCC fuels

“With coal and other dirty fuels like petroleum coke and furnace oil banned, industrial units will have to shift to cleaner alternatives such as piped natural gas, electricity or BS-VI diesel. It is encouraging to note that the use of natural gas by industries has expanded now in Delhi,” Roychowdhury said.

  • Bharat Stage VI compliant petrol and diesel with 10ppm sulfur
  • Liquid Petroleum Gas
  • Natural Gas or Compressed Natural Gas (CNG)
  • Aviation turbine fuel
  • Firewood for crematoriums and other religious purposes
  • Wood charcoal for Tandoors and grills of hotels, restaurants, banquet halls and eateries having an emission control system.
  • Biogas
  • Refuse Derived fuel (only for waste to energy plants)
  • Coal with low sulfur (less than 0.4%) will be permitted for use only in thermal power plants.
  • Diesel (BS-IV with 50ppm Sulfur)

This notification is an amendment to the list of approved fuels launched on August 27th, 1996. It was a decision which was made due to the widespread use of dirty domestic and industrial fuels in the city. It is advised that you should follow the guidelines of there will be DPCC penalty charged.

Why was this list of DPCC fuels necessary?

  • This move was the need of the hour because of the rampant use of sulfur-heavy fuels like furnace oil and petroleum coke. And it is found responsible for generating an “enormous” amount of air pollutants and it needs immediate attention.
  • Due to a “crash” in the global fuel prices, there has been a spike in sales of furnace oil (which is bottom of the barrel product at the refineries) and pet coke (which is a by-product).
  • Due to the combustion of sulfur, there is an emission of particulates and gaseous pollutants like Sulfur Dioxide (SO2). As a result, the gas converts into particles (depending on the level of moisture in the air).
  • As per the IIT- Kanpur report, these secondary particles are the primary source of winter pollution in Delhi. And 25-30% is from the vehicles, power plants and industries.
  • And the EPCA [Environment Pollution (Prevention and Control) Authority] exposed that there are high levels of sulfur (as much as 74,000 ppm in pet coke and 23,000 ppm in furnace oil). The usage of these fuels was without any standards and any pollution control equipment for SO2 (Sulfur Oxide) and NOx (Nitric Oxide).

What are the effects of such a move?

As per the list of DPCC fuels, coal is exempted from use from everything except in power plants, where coal with 0.4% sulfur will be permitted. Delhi though has decided to shut down its coal power plants- including the Badarpur plant.
With the ban on coal and other dirty fuels like pet coke and furnace oil, industrial units will be required to shift to cleaner alternatives. Such as piped natural gas, electricity or BS-VI diesel.                                                                          Says Roychowdhury: “It is encouraging to note that the use of natural gas by industries has expanded now in Delhi.”
The Supreme court has banned the use of pet coke and furnace oil in Delhi, Haryana, Rajasthan, and Uttar Pradesh.

DPCC subsidy

DPCC subsidy means the subsidies introduced by the Delhi Pollution Control Committee to the users of e-fuels. It ranges from transport (e-rickshaws or other vehicles) to industries. This was to reduce the pollution in Delhi NCR. and to motivate other industries that are polluting in nature to shift the procedure of their production and reach for sustainable development. This is one of the many objectives of DPCC that they perform.

The incentive to eateries using eco-friendly fuels

DPCC subsidy

The cabinet approved the Environment Department proposal for the grant of subsidy to restaurants, eating houses, banquet halls, hotels for replacing/conversion of their coal-based tandoors with electricity or gas-based tandoors,” a Government statement said.

As per the proposal, there would be a grant of subsidy of the cost or maximum subsidy of Rs.5,000 per tandoor (whichever is less). This subsidy was initiated from 1st April 2018.

DPCC implemented and monitored the subsidy scheme. Including this, it has also finalized the Standard Operating Procedure (SOP), application form and format of inspection/verification report for processing the case of grant of subsidy.

Industries switching fuels attracting subsidies

DPCC subsidy

This subsidy was announced to industries that have switched to PNG (Piped Natural Gas) instead of other polluting fuels. There was an approval of Rs.50,000 to small industries and Rs.1,00,000 to large industries to be provided.

“The scheme will also be extended to those units which have taken their connections during 2017-2018. The Delhi Pollution Control Committee (DPCC) will be authorized to issue cheques/DD in favor of Indraprastha Gas Limited (IGL) for the units which switch over to PNG as per the confirmation list provided by IGL. IGL shall transfer the incentive amount in the PNG account of the industrial unit with IGL,” the statement said.

In addition to this, an advisor to the CM said “The DPCC has also been asked to finalize the standard operating procedure (SOP), application form and format of inspection and verification report for processing the cases of subsidy. Approvals for payments of both schemes will be met by the Air Ambience Fund maintained by DPCC,”.

Subsidy to e-rickshaws

DPCC subsidy

On July 15th, 2017, Delhi CM Arvind Kejriwal released a subsidy of Rs.30,000 each to 6,000 e-rickshaws.

He commented that” pollution is among the biggest problem faced by the residents of Delhi and E-Rickshaws provide a solution to air pollution and last-mile connectivity.”

The total subsidy amounted to Rs.15 crores (verified by Transport Department). This amount was transferred directly to the recipient’s bank account.

In the year 2015, the Delhi government initiated a subsidy of Rs.15,000 to newly purchased e-rickshaws which were authorized and registered by the Transport Department. And on 1st April 2016, this amount was changed to Rs.30,000.

Subsidy to the general public

There is a 15% subsidy for all those customers who involved in purchasing Hero electric bike. This was initiated by DPCC and all you need to do is to submit required documents.

The amount would be transferred to the buyer’s account after the vehicle is purchased. This scheme is applicable to Delhi customers only and not from any other state.

In addition to this, there will be zero Value Added Tax (VAT) and a 50% reduction in Road Tax. As per the statistics, a total of 45,000 customers have benefitted from this scheme. The Electronic Vehicle they purchased was found 60% cheaper to run, 70% cheaper to upkeep and 90% less polluting as compared to petrol scooters.

This vehicle was tested completely environment-friendly as it produces zero tailpipe emissions. Anyone from the age group of 16-60 can drive this vehicle at a safe speed, making it reach wider audiences.

  • For Pure Electric/Battery Electric Vehicles: Subsidy by the DPCC is provided as per the cost of the vehicle provided to the purchaser.
  • Two-wheelers: For 2 wheelers the following table describes the subsidy amount:

DPCC office or Delhi Pollution Control Committee is a self-governing body that was established by the Delhi Government under the guidance of the Central Pollution Control Board (CPCB). It was set up on 1st June 1991 and the powers of CPCB has been delegated to DPCC.

The Head Office of DPCC office is designed by M: OFA Studios, New Delhi. It was commissioned through a design competition, houses about 200 officials, scientists & a devoted workforce. This building will host a permanent exhibition on Green Technologies and Innovations as an awareness drive in its Plaza and Exhibition Center for the people to learn, percolate the information, implement and through Osmosis benefit the social fabric ultimately.

DPCC categories

DPCC categories of industries is done into four categories. The pollution index of each is the basis for each category type. The categories are as follows:

  • White category
  • Green category
  • Orange category
  • Red category

White category

The government of Delhi introduced the white category in 2016 which comes under DPCC categories to segregate the least polluting industry type of all. And as they are the non-polluting industry, so they don’t need the Consent to Operate and Consent to Establish. The industries falling under this category operates in

According to DPCC categories, the white category industry type has a pollution index from 0-20. This is considered the least pollution industry type.

Green category

All the industries that have the pollution index from 21-40 come under this category of industries. As these are considered polluting industries, so these industries have to get consent to operate and consent to establish.

Orange category

According to DPCC categories, orange category industries have a pollution index of 41-59.

And just like in the green category, orange category industries also have to submit the consent certificates before establishing and operating the industry.

Red category

Every industry that deposit hazardous and noxious materials come under Red category industries. Industries coming under this category are not permitted to function in Delhi jurisdiction.

H-category (DPCC categories)

The further classification of the red category has been done to H(a) and H(b) categories. These industries are not permitted to operate in the Delhi jurisdiction and includes all the hazardous/heavy/noxious and large industries.

DPCC

Obtain DPCC License is a process that every industry needs to go through to legally operate in the NCR. (Delhi Pollution Control Committee) is an independent governing body that was instituted by the Delhi government under the administration of the Central Pollution Control Board (CPCB). This body was established on 1st June 1991. Every power and function of CPCB has been transferred to DPCC.

This organization was created to spread awareness about sustainable development that also guarantees an improvement in the “environment quality” of the NCR.

DPCC consent

Delhi comes under the Air Pollution Control Area by section 19 (1) of the Air Act. This means that no industrial plant is allowed to emit any type of pollutant (be it solid, liquid, or gaseous) into the environment with the prior consent of the DPCC.

This certificate functions as a bond that makes sure that every industry works in such a way that it doesn’t harm the environment.

In case your industry discharge waste in sewer, land, well, or stream, then you must apply for a DPCC license today.

Consent to Establish

CTE is the primary step for any industry/trade and activities involved in manufacturing processor and/or emitting pollution, by way of water/air/noise pollution.

This is a certificate that is a must for every industry, as per the Water Act, 1974 and Air Act, 1981. Every industry needs to obtain this before establishing an industry.

The validity for this certificate is of 1 year only, but if an industry is not able to establish within a year then it can apply for renewal. But if the period expires and there is no renewal, then the industry owner has to apply for the CTE certificate again.

Following 5 sections comes under Consent To Establish:

  • Wastewater aspects
  • Air emission aspects

Consent to Operate

The same acts mentioned above, provide details about consent to Operate. After obtaining the Consent to Establish, the industry needs to ascertain the Consent to Operate.

The validity of this certificate is of 5 years in the case of the Orange category and 10 years in the case of the Green category. Once this period expires, the industry needs to renew this certificate with the DPCC.

Within 4 months of the receipt of the application of consent, DPCC is to grant the consent to establish. Once all the other formalities such as MCD license, power-water connection, CETP membership (if CETP membership exists) is through, then the industry can get the Consent to Operate.

Who is to apply for DPCC consent?

Any individual or business entity that generates, collects, receives, stores, transport, treat, disposes and/or handles any kind of industrial waste in any manner, except clinics, dispensaries, pathological laboratories, blood banks providing their services to less than 1000 patients/month. All of these institutions need to make an application in Form I to the DPCC for grant of CTO and CTE.

Government Fee charged to obtain DPCC license

The following are the charges decided by the Government:

The operator of the facility of Bio-medical waste Rs.10,000/annum
Transporter of Bio-medical waste Rs.7,500/annum
Clinics, path-labs, and blood banks Rs.1,000/annum
Veterinarian Institutes, Dispensaries, and Animal houses Rs.1,000/annum
Hospitals, nursing homes, and health care establishments (up to 4 beds) Rs.100/bed per annum (from 5th bed onwards)
Health care establishments/units run by government/ government body/Non-Profit Organization Rs.100/annum

All the industries coming under the Red category are not to obtain DPCC consent. This is because these are extremely polluting industries, having a pollution index of above 60. These industries cannot obtain the certificate, as these are not permitted to set up in the NCR.

Prohibited/negative industries as per DPCC

Including this, all the industries falling under the White category need not obtain consent as well. This is because these industries are technically non-polluting, having a pollution index of 0-20. These can be set up without consent in the NCR.

DPCC penalty

DPCC penalty is charged by the Delhi Pollution Control Committee. Delhi Pollution Control Committee is a self-governing regulatory body founded in 1991, by the Delhi Government under the supervision of the Central Pollution Control Board. All the rules and regulations are approved by DPCC.

DPCC has many cases of a penalty imposed in the last year only. Here we will discuss some of the most widely known cases. In some cases, there is provision for non-working/monetary fine to complete sealing of the industry. It all depends on the severity of the crimes.

Types of DPCC penalty Licenses

DPCC issues a license known as DPCC license. It works as a NOC (No Objection Certificate) to assure that the proposed/existing business entity being set up will not cause any harm to the environment or society. So, every entrepreneur wishing to set up an industry or already established business must ascertain this certification from the DPCC.

DPCC consents are of 2 types of Consent to Establish and Consent to Operate.

Consent to Establish

CTE is the initial step for any industry/trade (including activities involved in manufacturing processes and/or emitting pollution, by way of water/air/noise pollution).

It is a certificate that every industry must obtain as per the Water Act, 1974 and Air Act, 1981. As the name suggests, this certificate must be obtained before establishing any industry.

CTE is valid for 1 year only. In case the industry is not able to establish it within a year, then it can apply for renewal for the same. But if it’s not done, then the industry has to apply for consent to establish a certificate again.

Consent to establish contains the following 5 sections:

  • General
  • Wastewater aspects
  • Air emission aspects
  • Hazardous waste aspects
  • Additional information

Consent to Operate

The Water Act and Air Act have also provided guidance about Consent to Establish. Every industry must ascertain the Consent to operate after the Consent to Establish.

This certificate is valid for a period of 5 years only in the case of Orange category industries. And it is valid for a period of 10 years in the case of Green category industries. Once, the validity expires, this certificate must be renewed.

The consent to operate is given, once the DPCC is satisfied that all other formalities such as MCD license, Power-water connection, CETP membership (in case CETP membership exists) have been through.

Cases of DPCC penalty

Clinics banned for violating biomedical waste rules

 On 8th July 2019, a small dental clinic located in the South Delhi area was fined Rs.14.30 lakhs as a penalty. This was charged on account of operating without obtaining/applying for mandatory authorization under Bio-Medical Waste Management Rules, 2016. For the hospitals, you need DPCC license for clinics.

There was a letter issued, that quoted

“According to section 10 of the Bio-Medical Waste Management Rules, 2016, every occupier or operator handling the biomedical waste, irrespective of the quantity shall make an application in Form II to the prescribed authority, i.e. Delhi Pollution Control Committee” for grant of authorization.” 

For Bio-medical waste, an industry required DPCC authorization.

Fines imposed on industries illegally operating in rural areas

 On 28th June 2019, a fine of 11.4 crores is imposed on 13 industries operating in Jindpur and Mukhmelpur of Alipur district after inspections were held. DPCC joined hands with the area SDM to carry out the research on these industries.

These industries were dyeing, annealing, oil-quenching, electroplating, plywood furniture, drinking water packaging and rice mills, along with other activities. The plots on which they were operating were larger than 1000 sqm. with huge pollution potential. After this, the electricity supply was disconnected and they were imposed with a fine of Rs.11.4 crore.

Closure of hospitals violating biomedical waste norms

 On June 27th, 2019, 12 hospitals were given closure directions and given 7 days to vacate patients and close down. Till June 26th, 56 violators of the norms were identified.

As hospitals are the places where the lives of people are at stake, DPCC is being ‘extra cautious’ and handing over closure directions only after ensuring the latest status of authorization. Also, it was commented by the DPCC that

“All those entities not generating any bio-waste are required to submit an affidavit for this purpose.”

Sealing of polluting factories

On 29th June 2019, DPCC sealed 3 “polluting” factories which were “operating without consent” in the Mayapuri scrap market in west Delhi. Many other factories were fined Rs.2-6 lakhs. On June 27th the same year, 12 units were also sealed in the C, E, W and F blocks of the locality.

These industries were engaged in illicit activities like electroplating, galvanizing, pickling, wood polishing, printing, etc. These activities would’ve been authorized had these industries obtained the consent for the same.

DPCC penalty for national-level Corporation

 National Building Construction Corporation (NBCC)

On 28th September 2019, DPCC fined Rs.5 lakh on the Central government-run National Building Construction Corporation for violating construction norms. They further elaborated that the fines were imposed due to “negligence’ in checking dust emissions at the site of the under-construction WHO building in ITO.

The DPCC team visited the site of the ITO as a part of their ongoing drive to check dust emissions at construction sites. The team found a large quantity of construction material lying uncovered.

Public Works Department (PWD) and South Delhi Municipal Corporation (SDMC)

While the NBCC was fined, PWD and SDMC were also fined Rs.50 lakhs after the demolition and construction waste was found lying on a stretch of the Ring Road. The officials commented that:

“Debris on a stretch of the ring road was found, from Brar Square to Dhaula Kuan, significantly contributing to re-suspension of dust particles. Both agencies, the PWD and the SDMC responsible for the cleaning of the roads, were found wanting.”

Sealing of illegal plastic recycling units

According to the new report published on 30th June 2019, DPCC conducted a 4 day-drive from 25th June. During this time, 210 units were inspected and 75 units were sealed with their electricity connection disconnected.

These 75 industries were found either operating without consent or in non-conforming areas. The officials seized 11,000 metric tonnes of plastic. The DPCC officials comments on the seized plastic are as follows:

”DPCC has issued directions under section 5 of the Environment Protection Act to seize plastic found in such illegal units and send them to waste-to-energy plant for disposal.”

DPCC penalty for 1,500 units for pollution

 On 9th April 2019, DPCC fined Rs.1 lakh environment damage charges each on 765 units directly/indirectly causing pollution inside/outside premises in Mayapuri. The fined industries were found throwing solid waste into the drain or discharging untreated effluent into the stormwater drain. Along with this, the direction of closure was also issued to these industries.

DPCC also made SDMC remove 305 tonnes of scrap lying on public land in the Mayapuri industrial area. And for the EDMC, DPCC provided directions for closure or sealing of all godowns being operated in the Sonia Vihar area. For the municipal authorities, directions were issued to shut polluting industries in non-conforming/residential areas in Delhi.
